Legislative Updates

4141 and 2479 are the Bills we had to work on after learning about them at the last minute. We were successful in getting them halted this session but we need to be watchful again next year and during the interim sessions.

The highlights for the recent legislative session on legislation
that directly effects security operations, are as follows:

SB 422

WV Code 16-4D-4, amended to relieve liability for AED (defibrillator) users that administer the AED in "good faith"

Passed, now to governor

Governor should sign into law.


SB 390

30-18-11, amended clarifying language concern any person whom violates "private investigative and security services" licensing law and regulations that the "court" assesses the "fine".

Passed, now to Governor

Governor should sign into law. Neither ASIS nor PIPSWV objected.


HB 4141

30-18-1. New bill to replace existing investigative and security company regulating law. Move jurisdiction from Sec. of State to Dept. of HLS & Crim. Justice.

Died on House floor after 3rd reading vote. After passing out of House Judiciary and Gov. Org. committees.

ASIS and PIPSWV objective and lobbied against this bill. Detrimental to small business, stay under SofS since Bus to Bus activity, did not include proprietary, added to state bureaucracy and budget, no input from private investigators nor security companies.


HB 2479

30-18-1. Total revamping of current security laws.

Did not get out of Gov. Org. committee and died.

ASIS, PIPSWV, and SofS all strongly opposed. Increased fines,
registrations, registration fees, increase surety bonding, additional time and expense staffing for Sec of State's office.


HB 4397

Flexible Leave Act

Died in House & Senate joint committee

Numerous businesses and Chambers' strongly opposed and lobbied against. Interference with company absentee policies, holiday leave, no limits on personal leave use for any reason, vague.

These are the bills that directly affect private security and investigative firms that had attention enough to pass into law. I am enclosing additional information at the ASIS monthly chapter meeting on 3/15/2010.
